General Terms and Conditions of Sale of Montreux-Vevey Tourisme

1. Scope of Application of the General Terms and Conditions of Sale

1.1. Montreux-Vevey Tourisme as Service Provider / Organizer

These General Terms and Conditions of Sale (hereinafter GTC) govern the contractual relationship between the client and Montreux-Vevey Tourisme (Association headquartered at 1820 Montreux, Rue du Théâtre 5 and hereinafter referred to as MVT) regarding services for which MVT itself operates as a service provider / organizer (e.g., package offers, city tours).

These General Terms and Conditions of Sale must be accepted by the client at the time of ordering. Details are set out in Section 3 below.

1.2. Montreux-Vevey Tourisme as Intermediary for Third-Party Services

If MVT acts as an intermediary for third-party services (e.g., hotel reservations, excursions, activities, concert tickets, etc.), the contract is established between the respective third party and the client. Any handling of the ordering procedure by MVT does not change the fact that the contractual relationship in this case is established between the third party and the client. In this case, the General Terms and Conditions of Sale of the respective service provider explicitly mentioned in the offers apply. Details are set out in Section 4 below.


2. Montreux-Vevey Tourisme Website www.montreuxriviera.com

2.1. Content of the Montreux-Vevey Tourisme Website

MVT operates the website www.montreuxriviera.com and offers its own services on this site. The site also offers third parties the opportunity to offer their own services.

2.2. Exclusion of Warranty and Liability

MVT takes all precautions to ensure the reliability of information published on its website. However, no explicit warranty is given for the accuracy, reliability, or completeness of the information. Furthermore, MVT cannot guarantee that the website operates without interruption or that the server contains no harmful components. Any liability of MVT resulting from access to or use of elements of the website is excluded.

2.3. Links

MVT is not responsible for the content or operation of linked third-party websites. The organization has no influence on the design of the content of these websites. Consultation of these websites is at the client's own risk.


3. Montreux-Vevey Tourisme as Organizer / Service Provider

3.1. Montreux-Vevey Tourisme as Organizer

If MVT operates as organizer of offers such as packages or city tours, the contract between MVT and the client is established.

3.2. Formation of Contract with Montreux-Vevey Tourisme

The offers on the website or in other MVT communication media are non-binding offers (invitation to make an offer). With their order (in writing, by email, by telephone, by submitting the completed entry form), the client submits a binding offer to MVT for conclusion of the contract and accepts MVT's GTC as well as the cancellation conditions. If receipt of the order is then confirmed to the client (by telephone, in writing, by email, or by an automatic message), this acknowledgment of receipt does not yet mean that the offer is accepted. The contract is only formed when MVT accepts the client's offer and explicitly confirms the order to them.

If the client has only transmitted a non-binding request for an offer by telephone, in writing, by email, or by submitting the completed entry form, MVT's response constitutes the binding offer for conclusion of the contract. In this case, the contract is formed upon the client's explicit acceptance of the offer.

3.3. Performance of Contract and Cancellation

MVT undertakes to properly perform the services that are the subject of the contract. However, it is explicitly stated that in the case of events offered by the organization, late participants are not necessarily expected; this should in no way be considered poor performance of the contract by MVT.

If the service becomes impossible or is cancelled by MVT after conclusion of the contract for reasons for which MVT alone is responsible, payments already made by the client will be refunded. Any claims still owed by MVT to the client arising from the cancelled reservation are cancelled.

If the service becomes impossible or is cancelled by MVT for reasons for which MVT is not responsible, MVT is not obliged to provide a refund.

The cancellation conditions stipulated in Sections 3.6 to 3.9 of MVT, which the client must accept when ordering, are decisive for the financial consequences of cancellation of the service by the client.

3.4. Liability of Montreux-Vevey Tourisme

MVT is only liable for premeditation and gross negligence in the cases mentioned in this section in which it operates as organizer/service provider. Liability for slight negligence and liability for auxiliaries is excluded. MVT is in no case liable for the client's own fault and for the fault of third parties. Liability for loss of profit or for other direct or indirect consequential damages is excluded. Furthermore, liability resulting from access to or use of elements of the website www.montreuxriviera.com is excluded.

The client is solely responsible for the proper safekeeping of valuables during events organized by MVT.

3.5. Sale of Merchandising Items by Montreux-Vevey Tourisme

The sale of merchandising items by MVT is exclusively governed by the regulations of the Swiss Code of Obligations on purchase (CO 184 et seq.).

3.6. Public Guided Tours

No reservation will be refunded. MVT reserves the right to cancel guided tours if the minimum number of visitors is not reached and in cases of force majeure. In this case, the client may request a refund or exchange. Tickets for guided tours can be paid for at tourist information points in cash, by credit card, or online by credit card.

3.7. City Tours for Groups and Private Individuals

For group and private individual city tours, payment is made by credit card. A fee of CHF 25 is charged for issuing an invoice.

MVT reserves the right to issue a prepayment invoice for confirmed services. All prices are in Swiss francs, including legal VAT.

3.7.1. Cancellation Fees

In case of cancellation by the client, the following fees are charged:

  • Non-appearance of the group (no show): 100%
  • 1 to 7 days before the tour: 100%
  • 8 to 15 days before the tour: 50%
  • Upon booking until 31 days before the tour: CHF 25 service fee

3.7.2. Reservation Modifications

The first modification of an order is free. A service fee of CHF 25 applies for each subsequent modification.

3.7.3. Delays / Guide Waiting Time

In case of delay, the tour time is reduced accordingly. Our guides wait on site for a maximum of 30 minutes.

3.7.4. Program Changes and Cancellation of a Guided Tour by MVT

A guided tour may be modified for unforeseeable reasons. In this case, MVT strives to find equivalent compensation or another appropriate solution. In cases of force majeure, government measures, shipwrecks, technical breakdowns, etc., MVT may cancel a tour and refund the amount already paid.

3.8. Sale of Package Offers by Montreux-Vevey Tourisme

In addition to the provisions stipulated in Sections 3.1 to 3.4, the following conditions apply to package offers sold by MVT:

3.8.1. Package Offer

There is a package offer when accommodation (minimum one night) is offered together with another tourist service at a total price.

3.8.2. Payment Conditions

As part of a package offer, advance payment of the price is due upon conclusion of the contract. Prices are fundamentally in Swiss francs and including VAT. The legal tourist tax per person per night is charged in addition to the overnight rate.

A fee of CHF 25 is charged for issuing an invoice.

3.8.3. Cancellation Fees

In case of cancellation by the client, the following fees are charged:

  • Waiver of a package offer (no show): 100%
  • 1 to 7 days before the overnight stay: 100%
  • 8 to 30 days before the overnight stay: 50%
  • After booking, until 31 days before the overnight stay: CHF 50 processing fee

In case of impediment, a replacement can fundamentally be designated who takes over the arrangement under the same conditions. The prerequisite is that the replacement guarantees the product price jointly and severally and that the service providers participating in the package offer (e.g., hotels, organizers, etc.) accept this change.

3.8.4. Cancellation Fee Insurance

Cancellation fee insurance can be taken out additionally for a surcharge and covers cancellation fees in case of illness, accident, or death of a trip participant or persons close to them. In these cases, in addition to written cancellation, the reason for cancellation must be proven and travel documents already provided must be returned. The processing fee (section 3.8.3) is not covered by the insurance.

3.8.5. Program Changes and Cancellation of Package Offer by the Organizer

The package offer may be modified for unforeseeable reasons. In this case, MVT strives to find equivalent compensation or another appropriate solution. Any shortfall between advertised and actually provided services is compensated to the extent that MVT or a service provider is at fault in accordance with Section 3.4. In cases of force majeure (natural disasters, unrest, strikes, etc.), government measures, shipwrecks, technical breakdowns, etc., MVT may cancel the offer. If MVT cancels the offer before the start of the trip, the package offer price already paid is refunded.

3.8.6. Reservation Modifications

A service fee of CHF 50 applies for each modification.

3.8.7. Complaints

If the package offer does not correspond to what was agreed by contract or if damage results from it, the corresponding defect or damage must immediately be complained about to the service provider concerned. If an adequate solution could not be found on site with the service provider and if the defect cannot be remedied or not sufficiently, a corresponding written complaint must be sent to MVT at the latest 30 days after the end of the contractually agreed offer. In case of failure to complain to the service provider on site or in case of non-compliance with the written complaint deadline with MVT, all claims lapse without further consequence.

3.9. Special Conditions for the Fête des Vignerons 2019 Package

For the Fête des Vignerons 2019 package, special conditions apply in addition to Section 3.8. From written confirmation by MVT, no modification or cancellation of the reservation is possible. Mandatory cancellation insurance is included in the price, which covers any postponement or cancellation of the show by the organizer. 4. Intermediation of Third-Party Services

4.1. Third Parties as Organizers and Contractual Partners of the Client

If MVT acts as an intermediary for third-party services (e.g., hotel rooms, excursions, activities, concert tickets, etc.), the contract is established between the client and the corresponding organizer by virtue of the third party's service provision. MVT is not considered a contracting party. Third-party services are subject to the contractual conditions of the service provider.

4.2. Formation of Contract with the Third Party

Third-party offers on the website or in other MVT communication media are to be considered non-binding offers from the third party. By their order (in writing, by email, by telephone, by submitting the completed entry form), the client submits a binding offer to the third party for conclusion of the contract and accepts MVT's GTC as well as the third party's cancellation conditions. If receipt of the order is then confirmed to the client (by telephone, in writing, by email, or by an automatic message), this acknowledgment of receipt does not yet mean that the offer is accepted. The contract with the third party is only formed when the client's offer is accepted and the order is explicitly confirmed to them. If the client has only transmitted a non-binding request for an offer by submitting the completed entry form, the response that arrives constitutes the binding offer for conclusion of the contract with the third party. In this case, the contract with the third party is formed upon explicit acceptance by the client.

4.3. Performance of Contract and Cancellation

Only the third party as the client's contractual partner is competent to perform the contract. The third party's contractual conditions are decisive. MVT provides no guarantee for proper performance of the contract by the third party. Any complaints must be addressed solely and immediately to the third party.

In case of cancellation, the third party's GTC or cancellation conditions apply.

4.4. Exclusion of Liability

MVT assumes no liability whatsoever for damages suffered by the client in connection with the third party's service. Any compensation claims must be addressed to the third party.

4.5. Payment Conditions

In the absence of a different agreement by the parties in the particular case, payments by selected debit and credit cards as well as cash payments on site in Swiss francs and euros are accepted. All prices indicated are in Swiss francs, including legal VAT, accommodation tourist tax extra.

4.6. Specific Conditions for Congress/Conference Participants and Groups

Specific contracts are concluded between the service provider and the client; the service provider's cancellation and payment conditions apply. Any modification or cancellation of a reservation must imperatively be communicated in writing to MVT. A processing fee of CHF 25 will be charged by MVT for handling each reservation modification or cancellation.


5. Montreux Riviera Card

The Montreux Riviera Card (MRC) is valid for any stay from one night in the region (except Lavaux); it is provided by the accommodation provider (hotels, vacation rentals, campsites, clinics).

The MRC is fully financed by the Tourist Tax and entitles the holder to free or reduced-price third-party services. MVT is not responsible for non-distribution of the MRC by the accommodation provider or for insufficiently provided third-party services. The availability of services may vary according to season.


6. Intellectual Property / Rights to Intangible Assets

All content of the website www.montreuxriviera.com as well as the content of the newsletter to which one can subscribe are protected by copyright. The owners of the protected elements are either MVT or third parties who have consented to MVT exploiting these elements. Website visitors are granted neither property rights nor exploitation rights to website elements or software, in particular no license to content protected by copyright or trademark rights.

The contents and all elements on the website may only be downloaded or printed if copyright notices or other protective characteristics have been removed and if source indication is made. MVT expressly reserves all rights.

Complete or partial reproduction, transmission, modification, or use of the website www.montreuxriviera.com for public or commercial purposes is prohibited without MVT's prior written consent.


7. Data Protection

MVT undertakes to process personal data (data about a specific or identifiable person) in compliance with the provisions of Swiss data protection legislation. Reference is made in this regard to MVT's data protection statement.


8. Final Common Provisions

8.1. Severability Clause

If a provision of these General Terms and Conditions of Sale should be invalid in whole or in part, it will be replaced by an equivalent provision that most closely approximates the economic value of the invalid provision. The validity of the other provisions is not affected.

8.2. Adjustment of these GTC

MVT reserves the right to modify these GTC at any time. The respectively applicable version is published on www.montreuxriviera.com and applies to orders placed as of the online publication date. The version in effect on the date of the order is decisive.

8.3. Competent Jurisdiction and Applicable Law

Only Swiss law is applicable to the contractual relationship between MVT and the client. Subject to mandatory jurisdiction, the courts at MVT's registered office have jurisdiction for disputes between MVT and the client.
